The federal regulations governing mortgage servicing in the United States are detailed, specific, and largely unfamiliar to most homeowners. The core servicing framework that applies across most loan types includes:
Under 12 C.F.R. § 1024.36, your servicer must identify the actual owner of your loan in writing on request. This is the threshold determination — the answer dictates which programs apply.
Under 12 C.F.R. § 1024.39, your servicer must attempt live contact about loss mitigation by day 36 of delinquency and must send written notice listing examples of available options by day 45.
Under 12 C.F.R. § 1024.41(f), the first foreclosure step cannot be taken until the borrower is at least 120 days delinquent.
Under 12 C.F.R. § 1024.41(c), submission of a complete loss mitigation application starts a 30-day window during which the servicer must evaluate every program the borrower may qualify for.
Under 12 C.F.R. § 1024.41(g), foreclosure cannot move forward while a complete loss mitigation application is under review — provided the application was submitted more than 37 days before a scheduled sale.

Most conventional borrowers go through Fannie Mae Servicing Guide D2-3.2 or Freddie Mac Servicing Guide Chapter 9203 — the two versions of the Flex Modification program that aim to reduce monthly principal and interest by roughly 20%.
